
Jack Bauer escaped another close one.
Charges against “24″ star Kiefer Sutherland for head-butting a fashion designer at a ritzy Manhattan party were dropped yesterday, prosecutors said.
The Hollywood action hero caught the legal pass as officials said victim Jack McCollough was “uncooperative.”+
“We declined to prosecute after a full investigation, including talking to the complaining witness who was quite uncooperative,” a spokeswoman for District Attorney Robert Morgenthau said.
Sutherland, 42, was charged with misdemeanor assault in May after he allegedly smashed his head into McCollough at a SoHo nightspot – breaking the designer’s nose.
The head-pop came after McCollough, a trendy Proenza Schouler label designer, bumped into actress Brooke Shields and didn’t apologize at the Mercer Hotel at an after-party for a Met Costume Institute gala.
The tossing of the charges also benefited Sutherland in Los Angeles, where prosecutors decided the head-butt wasn’t serious enough to violate his probation from a 2007 drunken driving arrest.
Sutherland, who later offered a mea culpa on “Late Night With Jimmy Fallon,” reached a settlement with McCollough.
